Off-Plan Buying in Belgrade: Seven Red Flags Before You Sign

Buying before the building exists can save you 10–20%. It can also cost you every dinar if the project stalls. Here is the checklist serious buyers run before handing over a deposit.

Off-plan purchases (kupovina na papiru) are normal in Belgrade. They also carry the only real risk left in Serbian residential real estate, a half-built project with your money locked inside it.

1. The building permit is the only thing that matters

A građevinska dozvola (building permit) is not the same as lokacijska informacija or lokacijski uslovi. Those are preparatory documents. Do not wire anything until the permit is issued and public on the e-dozvola portal.

2. Land ownership, is it actually the investor's?

Pull the cadastre extract (list nepokretnosti) for the parcel. The investor should be the owner. If the land is leased, mortgaged, or held by a chain of SPVs, ask why.

3. "Pre-sale discount" vs. installment schedule

A 15% discount is not a gift, you are financing the construction. Match your payments to verifiable construction milestones, not calendar dates. No milestone, no tranche.

4. Penalty for delay, both sides

Your contract must include a late-delivery penalty clause (ugovorna kazna). Typical market terms: 0.05%–0.1% of price per day of delay after a grace period. If the draft doesn't have this, the investor expects to slip.

5. Who registers the mortgage to your bank?

If you are financing with a mortgage, the bank wants a first-rank mortgage on your unit. In pre-construction, the investor usually has a blanket mortgage on the whole parcel. The contract must spell out how and when the blanket is released on your unit.

6. Final area tolerance

The delivered apartment is almost never the exact contracted m². A ±2% tolerance with per-m² price adjustment is normal. Over 5%, you should have the right to walk away with a full refund.

7. Escrow or trust account, non-negotiable

Your payments should sit in a bank escrow (or a notarized trust arrangement) tied to construction progress, not on the investor's free-use account. Any investor who refuses this is telling you they need the cash flow to finish.

The smell test

If the sales agent rushes you, won't hand you the draft contract for independent legal review, or offers a discount "only until Friday", walk. Good projects in Belgrade sell themselves; pressure tactics are a signal, not a feature.
